Asbestos Laws

Asbestos laws have not been a constant. While mining regulations have tightened since the 1970s, some companies have ignored the consequences of the exposure of workers to asbestos. A notable lawsuit based on this disregard was filed against W. R. Grace and Company that were indicted in 2005. While various governmental agencies regarding health and safety as well as environmental protection have enacted legislation, enforcement of the laws has not always been on par with the intent of the law. As a result, asbestos laws may not be effective across the board. Moreover, governments, insurance companies and the asbestos industry has made several attempts to reduce the ability of individuals to bring lawsuits against the various individuals or corporations involved. The Compensation Act of 2006, and the Fairness in Asbestos Compensation Act of 1999 have been 2 attempts in the United States to regulate the amount of money available to victims of asbestos. Around the world, many countries have move to ban asbestos mining, manufacturing and importation. Some have only restricted the bans to amphibole asbestos. Some countries such as Canada and South Africa have not banned chrysotile, a serpentine asbestos. Asian countries continue to import and use chrysotile products.
