My husband got Mesothelioma from Asbestos Exposure from his construction job. Can we sue?

My husband, who worked in construction for many years, suspects that he has mesothelioma from years of exposure to asbestos at work. What will be necessary to begin a lawsuit against his former employer for this?

Your husband must first receive a definite diagnosis of mesothelioma. The diagnosis should be from an experienced oncologist or cancer specialist. Various tests should be performed including x-rays, a CAT scan, and a biopsy.

Once your husband is diagnosed with mesothelioma, you need to find an attorney experienced with mesothelioma and asbestos cases. The attorney should be consulted as soon as possible since there is a time limit on filing the lawsuit. The attorney handling the case will need information from your husband, including the following:

  • husband's job title;
  • husband's years of employment;
  • names of co-workers;
  • asbestos products that husband came in contact with at work;
  • signed releases allowing the attorney to access confidential documents such as medical records and employment information.

After obtaining all the necessary information, the attorney will proceed with filing a formal complaint.
